In general, North Dakota is a prior approval state for forms and rates/rules filings.

A rate/rule filing for commercial lines (with the exception of medical malpractice, farm owners and crop/hail insurance) is use-and-file (N.D.C.C. § 26.1-25-04). In other words, medical malpractice, farm owners and crop/hail insurance are prior approval.

A rate/rule filing of less than 5 percent for personal auto policy may be use-and-file once per calendar year per company. Otherwise, the filing must meet the prior approval standard (N.D.C.C. § 26.1-25-04).

A rate/rule filing of less than 5 percent for homeowners policy may be use-and-file once per calendar year per company. Otherwise, the filing must meet the prior approval standard (N.D.C.C. § 26.1-25-04).

Filing through the National Association of Insurance Commissioners (NAIC) System for Electronic Rates & Forms Filing (SERFF) is preferred over hard copy but both are allowed. The general filing requirements and guidelines for both can be found in Bulletin 98-1. For specific information relating to crop/hail filings, please see our annual bulletin.
